Babysitting Services Agreement
Babysitting Services Agreement and Liability Waiver
This Service Agreement ('Agreement') is entered into by and between The Perfect Maid & Nanny (hereinafter referred to as 'TPMN' or 'Service Provider') and [Client’s Name/Company] (hereinafter referred to as 'Client'). This Agreement outlines the terms and conditions governing the provision of babysitting services by TPMN.
1. License and Compliance
The Perfect Maid & Nanny holds a valid Trade and Business License issued by the Cayman Islands Government. All staff have completed criminal background checks and employment/character reference verification.
2. Office Hours
Monday to Friday: 8:00 a.m. – 5:00 p.m.
Saturday: 9:00 a.m. – 2:00 p.m.
Closed Sundays and Public Holidays (services may still be provided during these times).
3. Contact Information
Office: (345) 325-1507
Email: theperfectmaidandnannyky@gmail.com
Important: The office phone is not monitored outside of regular business hours. Urgent after-hours matters must be sent via email.
4. Our Staff
All TPMN babysitters are carefully vetted, trained, and selected for professionalism and reliability. Each team member represents TPMN and is expected to uphold our standards of safety, respect, and excellence at all times.
5. Communication Regarding Specific Needs
Clients must inform TPMN at the time of booking about any specific needs, medical conditions, allergies, or behavioral concerns relating to the child(ren). This ensures that TPMN can make appropriate arrangements for care.
6. Scope of Babysitting Services
Babysitting services are limited to in-home supervision and care of children. Unless expressly approved in writing by TPMN Management, babysitters are not permitted to: administer medication, engage in water-related activities (pool, beach, bath, etc.), drive or transport children, perform household chores outside of agreed childcare duties, share a sleeping area with a child, or invite visitors while on duty.
Bathing or hygiene assistance may only occur with prior written consent from the parent/guardian and approval from TPMN Management.
7. Client Responsibilities
The client agrees to provide accurate and complete information about the child’s needs and routines, maintain a safe and hazard-free environment, ensure pets are secured if aggressive, remain reachable during service hours, provide all necessary supplies, and refrain from requesting duties outside the approved scope.
8. Billing and Payment
Payment is required in advance to confirm any booking. Payment options include:
- Online Bank Transfer (local residents only)
- Credit/Debit Card (authorization form required)
- Cash Payment at Office (notify booking team in advance)
All services have a 3-hour minimum.
9. Cancellation Policy
Cancellations must be made at least 72 hours in advance to receive a credit (no refunds). Cancellations made within 72 hours or bookings made within 72 hours are non-refundable and non-creditable. All cancellations must be submitted by email, not phone. If a sitter cannot access the home within 15 minutes, the session is canceled with no refund.
10. Arrival, Schedule, and Cost Adjustments
Sitters may arrive up to 15 minutes before or after the scheduled time due to traffic or unforeseen delays. Service prices are based on the agreed schedule; any change may result in a rate adjustment. All schedule changes must be made through the TPMN office, not directly with the babysitter.
11. Emergency Protocol
In the event of an emergency: (1) Babysitter will call 911, (2) Babysitter will contact the parent/guardian, (3) Babysitter will notify TPMN Management immediately after emergency services are contacted. Parents must ensure that emergency contact details are accurate and up to date.
12. Allegations and Safeguarding
TPMN enforces a zero-tolerance policy toward abuse, neglect, or misconduct. Babysitters must not engage in inappropriate physical contact or private closed-door situations unless required for care and safety. Babysitters may not take or share photos or videos of children. TPMN will suspend services and cooperate fully with authorities if an allegation arises. Clients agree to refrain from making defamatory or unsubstantiated claims. TPMN reserves the right to terminate service immediately if a safety or ethical concern arises.
13. Limitation of Liability
The Client acknowledges and agrees that The Perfect Maid & Nanny, its owners, employees, contractors, and representatives shall not be held liable under any circumstances for any injury, loss, accident, claim, damage, or expense of any kind arising out of or related to babysitting services. The Client hereby waives, releases, and forever discharges TPMN and its babysitters from any and all claims, demands, or causes of action. The Client assumes full responsibility for the child’s safety, environment, and inherent risks. TPMN does not provide liability insurance.
14. Indemnification
The Client agrees to indemnify and hold harmless TPMN, its owners, and employees from all claims, damages, or expenses, including those arising from false allegations, the Client’s failure to disclose relevant information, or activities outside TPMN’s approved scope.
15. Ensuring a Safe and Respectful Environment
Clients must ensure a safe and respectful workplace for TPMN staff. Any form of verbal or physical abuse toward staff will result in immediate termination of service.
16. Termination of Services
For ongoing services, either party may terminate this Agreement with one (1) week’s written notice. TPMN reserves the right to terminate services immediately in cases of non-compliance, disrespectful behavior, or safety concerns.
17. Non-Solicitation
The Client agrees not to solicit, hire, or engage any current TPMN employee directly or indirectly during the term of this Agreement and for one (1) year thereafter without TPMN’s written consent.
18. Confidentiality
Both parties agree to maintain strict confidentiality of all information shared in the course of this Agreement.
19. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Cayman Islands.
20. Acknowledgment and Agreement
By signing below, the Client acknowledges that they have read, understood, and agreed to the terms and conditions set forth in this Agreement and fully release TPMN from all liability.
